Competition Rules For GIVEAWAY
The Prize is a 200AED gift card.
Date of the Competition: The Competition shall be carried out from 6th December 2023 to 8th January 2024 (23:59), and announced on 9th Jan 2024.
The Competition will be run on the Digital Qube website and shared on social media which may include: Instagram, Facebook, Youtube, TikTok, and LinkedIn with the handles of Digital Qube.
Specific Process for Choosing the Winner: Each person will receive multiple entries based on the number of people they tag, and a bonus entry if they share on their story. The winner will be chosen by Digital Qube for sharing the most inspiring comment.
Announcement of the Winner: Winner shall be declared by Digital Qube on the Digital Qube Instagram Profile (and Facebook)
The Winner will be offered the prize via DM and has 12 hours to accept (any responses received after this deadline shall be considered forfeited). The Winner shall be declared as per the terms of the Competition T&Cs. Digital Qube may choose not to announce any winner at their sole discretion.

TERMS AND CONDITIONS
FOR DIGITAL QUBE GIVEAWAYS & COMPETITIONS
These Competition Terms and Conditions (“Competition T&Cs”) apply to each Competition and Giveaway conducted by Digital Qube. The specifics of this Competition (hereinafter referred to as “Competition Rules”) are included above.
Digital Qube’s Competition & Giveaways to be conducted on its website, www.digital-qube.com, and promoted on Digital Qube’s social media channels.
Following are the terms that shall be applicable to the Competition:
1. The Competition is covered by the laws of the UAE but is open to applicants outside of the country. (All persons fulfilling the condition mentioned in section 1 shall be hereinafter referred to as “Participants”. By participating in the Competition, you, the Participant, signify your assent to these Competition T&Cs stated below and provided on Digital Qube’s website, https://www.digital-qube.com ("Website"). The Competition shall be open for participation as per the timelines specified in the Competition Rules.)
2. One Winner will be selected for the competition. The people who accept the prize must be 21 years or older (as on the date of the Competition). Participants younger than 21 years can enter the Competition with a parent’s or guardian’s supervision, and an adult guardian can be selected to accept the prize, but any Winner(s) aged under 21 must allocate the prize to their parent or legal guardian (aged 21+ years) to claim and use the Prize (outlined in section 7).
3. Employees of Digital Qube are not eligible to participate in the Competition.
4. Participants may be required to provide basic personal information about them, including but not limited to the Participant's name, address, mobile number and email address, in order to register or accept the prize. The information provided by the Participants may be used by Digital Qube for internal purposes, and to send in the future to the Participants promotional information pertaining to the Digital Qube network and their partners. Providing information to us is your choice. By providing the aforesaid sensitive personal information, the Participant hereby agrees that Digital Qube shall have the right to share the information so collected with such other third party as Digital Qube is required for the purpose of the Giveaway, and hereby agrees that they shall not file any claim against Digital Qube for sharing of such personal information. By participating in the Competition, the Participant hereby consents to receiving information about various marketing promotional activities/events of Digital Qube, including but not limited to receiving information/being contacted by the research team of Digital Qube. However, by participating in the Competition, you agree to allow us authorised use of your information.
5. Winner(s) (as applicable) must meet Digital Qube's team and criteria as specified in these Competition T&Cs, and the Winner(s) is declared at Digital Qube's sole discretion.
6. The manner, day and the basis of choosing the winner(s) ("Winner(s)") shall be specified in the Competition Rules. The announcement about the Winner(s) and the Prize (defined in the Competition Rules) shall be as per the Competition T&Cs. The distribution time and mode of distribution of the Prize shall be at the sole discretion of Digital Qube. Participants should ensure the accuracy of the information provided by them at the time of entering the Competition.
7. Method and time of Prize distribution: Winner(s) shall be contacted via social media, email or mobile number. Winner(s) can be asked to provide their information on Instagram or other social channels or to email valid photo identity documents and confirm they fit terms of entry. Winner announcement day is listed in the Competition Rules.
8. Participants shall not post any profanity or abusive comments on the respective social media handles or Website/Competition page/s. In the event of any such profanity or abusive comments being posted, such Participants shall be disqualified forthwith and Digital Qube reserves its rights, in addition to removing such post, to take a legal action against such Participant and/or user.
9. Digital Qube, including its employees and divisions, affiliates and subsidiaries and their respective agents and representatives, shall not be responsible for any loss of Entries for any reason whatsoever, including due to any technical problems for Entries received after the deadline as a consequence of computer service delays, interruptions, electronic failures or overloads, or for lost, misdirected or misplaced Entries.
10. Digital Qube reserves its right to select and declare or not to declare the Winner(s) in the Competition. Mere participation/submitting Entries in the Competition does not entitle Participants to win the Prize. The Prize will be awarded to the Winner(s) pursuant to verification and in accordance with these Competition T&Cs.
11. Digital Qube may refuse to award the Prize to the Participant in the event of his/her fraud, dishonesty or non-entitlement to participate in the Competition under these Competition T&Cs. The Prize is not transferable, assignable or exchangeable for cash equivalent. Only the prize Winner(s) and no other person or agent may claim the Prize. In case the Winner(s) is found to be in violation of any and all rules of the Competition, Digital Qube reserves the right to initiate legal proceedings against such person. Digital Qube has the right to substitute the Prize with other prizes of equal value, as determined by Digital Qube in its sole discretion. Digital Qube does not accept any responsibility and is not liable to pay compensation if the Winner(s) is unable to take up the prize.
12. Digital Qube has the right to amend (add, delete or modify) the Competition T&Cs governing the Competition, prospectively or retrospectively, at its discretion and without prior notice. Digital Qube reserves the right to disqualify any participant if it has reasonable grounds to believe that the Participant has breached any of these Competition T&Cs.
13. Digital Qube is not responsible for any errors or omissions in the Competition T&Cs contained herein. All information provided in the Competition is provided "As is" without warranty of any kind. Digital Qube makes no representations and disclaims all express, implied, and statutory warranties of any kind to the Participant and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, merchantability or fitness for any particular purpose.
14. Under no circumstance, unless due to wilful misconduct or gross negligence, shall Digital Qube and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever. The Participant specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in UAE against Digital Qube, their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Competition or the Prize.
15. Intellectual Property clause:
By entering the Competition, the Winner(s)/Participants waive all copyrights including but not limited to Intellectual Property Rights (IPR) and moral rights, rights of publicity and any related rights and consents to Digital Qube's right to use the pictures and captions uploaded by the Participant(s) posted for the Competition, and pictures/videos/portrayals of him/her as a Competition Winner(s), and to exhibit this material in any and all media now existing or hereinafter created, including without limitation television, film, radio and print media, without any compensation whatsoever for advertising and publicity purposes, except where prohibited by law. The prize-Winner(s) also consents to Digital Qube's right to use his/her name, voice or picture, or the content of his/her Competition Entry (collectively, the "Publicity Rights"). Digital Qube can allow its agencies to exercise/exploit the Publicity Rights in conjunction with Digital Qube. Digital Qube shall also be free to use any ideas, concepts, know-how or techniques contained in the entries received for the Competition for any purpose.
16. Digital Qube does not make any commitment, express or implied, to respond to any feedback, suggestion and/or queries from the Participants, or to furnish any reason or explanation for inclusion and/or exclusion of any particular submission of the Entry of a Participant at any stage of the Competition.
17. The Participant agrees that he/she shall not hold Digital Qube and/or its employees responsible for delays or any problem in connection to the Competition. Digital Qube is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Participants and/or the Participant in any manner whatsoever or for any reason whatsoever in connection to the Competition.
18. The Participant shall do any and all acts and execute any and all documents in such manner and at such location as may be required by Digital Qube in its sole and absolute discretion to protect, perfect or enforce any of the rights granted or confirmed to Digital Qube herein.
19. The content, including (without limitation) the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), all Entries, are owned by Digital Qube. Content is provided to Participant "As Is" for Participant’s information and personal use only, and it may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licenced or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Participant agrees not to engage in the use, copying or distribution of any of the Content other than expressly permitted herein, including any use, copying or distribution of user submissions of third parties for any purposes whatsoever.
20. Non-conformance by any Participant and/or Winner(s) of the Competition will result in immediate disqualification of the Participant from participation or winning the Prize as the case may be. Digital Qube reserves the right to withdraw or discontinue and/or terminate the Competition at any stage without prior notice and without any liability whatsoever to the Participants. The decisions of Digital Qube and its representatives shall be final and binding on all aspects of the Competition. Your participation in the Competition by posting the Entries will be deemed as an acceptance of the above stated Competition T&Cs.
21. Taxes, levies and duties due and owing under applicable and statutory laws in connection with the Prize, and other Government costs, levied on prizes, are the responsibility of the Prize Winner(s).
22. In exercise of the Privacy rules in UAE, which makes it mandatory for any concern to deal with any personal information including sensitive personal information as per the said Privacy Rules. In the course of providing the aforesaid Entries in the Competition, Digital Qube shall treat the information and pictures as per the UAE Privacy Rules such information will to be dealt with as per the provisions specified in the said Rules.
23. Digital Qube shall deal with any data/information, including sensitive personal information, if any, that it receives from Digital Qube or otherwise collects, holds, uses and processes in the following manner:
a) Digital Qube may disclose data/information, including sensitive personal information, if any, to governmental agencies and regulators (eg, tax authorities), social organisations (eg, the social security administration), human resources benefits providers (eg, health insurers), external advisors (eg, lawyers, accountants and auditors), courts and other tribunals, and government authorities, to the extent required by applicable legal obligations. Before providing information the Winner(s) can request prior written notice from Digital Qube.
b) The level of data protection using technical, managerial, operational and physical security control measures by Digital Qube shall be in compliance with all applicable laws including but not limited to IT Law and Privacy Rules of UAE.
c) The term ‘data/information’, including sensitive personal information, if any, shall mean and include the name and contact information (home address, telephone and fax numbers and email address), valid identity proof such as passport number, driver’s licence number, permanent account number (PAN), or other details pertaining to the identity of the Participants.
24. Participants confirm that the pictures uploaded by them or any part thereof do not infringe upon the statutory rights, common law rights, intellectual property rights including copyrights in literary, dramatic, musical or motion picture rights, patent rights or the trademark or trade names of any person, firm, corporation, association or entity whatsoever. Neither the Pictures nor any part thereof violate the statutory rights of, or the right of privacy, or constitute a libel or slander against any person, firm, corporation, association or entity whatsoever, or violate any other rights not herein specifically enumerated. No pictures or any part thereof shall be defamatory or contribute contempt of court or breach of contract, or breach of any provision of statute, nor hurt the sentiments of religious groups. In the event of any infringement and/or any unlawful usage of any information including pictures provided by the Participants, Digital Qube shall not be held liable on any account whatsoever.
25. Digital Qube may now or in the future permit the submission of the Entry(ies) submitted by Participant as a part of Entry, and the hosting, sharing and/or publishing of such Entry. Participants understand that whether or not such Entry(ies) are published, Digital Qube does not guarantee any confidentiality with respect to any submissions.
26. Once uploaded and published, Participants are not allowed to request for removal, editing or altering the Entry in any manner whatsoever. The Competition is void where prohibited by law. All relevant national and local laws apply. The Competition shall be governed by and construed in accordance with the applicable laws in UAE. All matters with respect to the Competitions are subject to the jurisdiction of the Courts at Abu Dhabi only. 27. You are entitled to request by email that Digital Qube does not contact you and removes your details from its database. If you make such a request, you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the Winner(s). If you do not wish any of your personal details to be used for promotional purposes, email CEO@digital-qube.com before the date listed in the Competition Rules. Winner(s) will be required to provide proof of identity to confirm eligibility. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the Prize.
